AFP-Kansas Celebrates End of Judicial Deference
TOPEKA, KS – Americans for Prosperity-Kansas (AFP-KS) celebrated legislation that officially became law (H.B. 2183) today that ends the practice of judicial deference and restores a critical check on the administrative state.
This law mirrors the 2024 U.S. Supreme Court decision on Loper Bright Enterprises v. Raimondo, which overturned the 40-year-old Chevron doctrine that granted federal agencies the ability to interpret the scope of their own regulatory. H.B. 2183 will similarly subject state agencies’ regulations to review by the courts.
Elizabeth Patton, Regional Director for AFP in Kansas, gave the following statement:
“We’re grateful to our legislative champions for their work on this crucial legislation to restore judicial impartiality and the balance of power in the state government.
“Our work doesn’t end here. AFP-KS will continue to encourage the legislature to rein the authority of unelected bureaucrats and the burdensome regulations that make life more difficult and expensive for hardworking Kansans.”
